Terms of Use

1. What the Service is

LowKiwi is a price-locating and comparison service. We search publicly available shopping information and third-party data sources and display offers from independent retailers. We are NOT a retailer, marketplace, broker or agent of any store. We do not sell, ship, stock, warrant or handle payment for any product.

2. No guarantee of prices, availability or accuracy

Prices, availability, shipping costs, taxes, promotions and product details are set by third-party retailers, change frequently and may differ from what is displayed. Information is provided "AS IS" and "AS AVAILABLE" as of the date and time shown with each comparison.

We do not guarantee that any product is in stock, that any price is current, complete or the lowest available, or that any offer will be honored. The price and availability shown on the retailer's website at the time of purchase apply. Always verify the final price, terms and availability on the retailer's website before purchasing.

3. Purchases are between you and the retailer

Any purchase you make is a contract solely between you and the retailer. The retailer is responsible for the product, price, payment, delivery, returns, refunds, warranties and customer service. Any dispute regarding a purchase must be resolved with the retailer.

4. AI-generated assistance

The Service uses artificial intelligence to interpret queries, identify products from photos and match listings. AI may make mistakes, including misidentifying a product or variant. You are responsible for confirming that a listing is the exact product you want.

5. Third-party links and affiliate relationships

The Service contains links to third-party websites we do not control. We are not responsible for their content, policies or practices. Many links are affiliate links; we may earn a commission when you purchase through them, at no additional cost to you. Commissions are never part of the "Best value" score, but they can affect what you see in two disclosed ways: in near-ties (within 1%) a commission-paying store may be listed first, and one commission-paying store may be shown in a "Suggested" box above the list. 5b. Free limit and paid comparison packs

Each visitor gets a number of free new comparisons per day (currently 10). Results already saved in our cache are always free. Optional packs of extra comparisons (currently 100 comparisons for US$4.99, one-time payment, no subscription) are sold through Lemon Squeezy, which acts as merchant of record and handles payment and any applicable sales tax, which is shown before you pay.

Credits are tied to a code shown to you after purchase; keep it safe, as we cannot recover it without proof of purchase. Credits do not expire while the Service operates. Refund requests are handled under Lemon Squeezy's terms; contact us if a purchase did not credit correctly.

6. Acceptable use

You agree not to: scrape, crawl or harvest the Service by automated means; overload or interfere with the Service; attempt to bypass rate limits or security; use the Service for any unlawful purpose; upload images you have no right to use or that contain unlawful content; or resell the Service's data.

7. Intellectual property

The Service's design, software, text and branding are owned by us or our licensors. Product names, images, logos and trademarks displayed belong to their respective owners and are shown for identification and comparison purposes only; no endorsement is implied.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM PRICES, AVAILABILITY, PRODUCTS, RETAILERS OR YOUR RELIANCE ON THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF US$50 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold us harmless from claims arising out of your misuse of the Service or violation of these Terms.

11. Children

The Service is not directed to children under 13 and is intended for users 13 and older. We do not knowingly collect personal information from children under 13. If you believe a child has given us personal information, contact us and we will delete it.

12. Changes and termination

We may modify or discontinue the Service or these Terms at any time. Continued use after changes means you accept them. We may restrict access for abuse.

13. Governing law

These Terms are governed by the laws of the Republic of Guatemala, without regard to conflict-of-law rules, except where mandatory consumer-protection laws of your place of residence apply.
